A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to requiring a municipality to pay for the expenses of an |
|
|
election contest for a person elected to the governing body of the |
|
|
municipality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 221, Election Code, is amended by adding |
|
|
Section 221.0135 to read as follows: |
|
|
Sec. 221.0135. EXPENSES OF CONTESTEE WHO IS ELECTED TO |
|
|
GOVERNING BODY OF CITY. A contestee who is elected to the governing |
|
|
body of a city is entitled to have the city pay the expenses of |
|
|
defending the election contest, including reasonable attorney's |
|
|
fees, court costs, and similar related expenses. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
