A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to the composition of the permanent advisory committee to |
|
advise the Texas Commission on Environmental Quality regarding the |
|
implementation of the ad valorem tax exemption for pollution |
|
control property. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 11.31(n), Tax Code, is amended to read as |
|
follows: |
|
(n) The Texas Commission on Environmental Quality shall |
|
establish a permanent advisory committee consisting of |
|
representatives of industry, appraisal districts, taxing units, |
|
and environmental groups, as well as members who are not |
|
representatives of any of those entities but have substantial |
|
technical expertise in pollution control technology and |
|
environmental engineering, to advise the commission regarding the |
|
implementation of this section. At least one member of the advisory |
|
committee must be a representative of a school district or junior |
|
college district in which property is located that is or previously |
|
was subject to an exemption under this section. Chapter 2110, |
|
Government Code, does not apply to the size, composition, or |
|
duration of the advisory committee. |
|
SECTION 2. As soon as practicable after the effective date |
|
of this Act, the Texas Commission on Environmental Quality shall |
|
appoint one or more representatives of school districts or junior |
|
college districts in which property is located that is or |
|
previously was subject to an exemption under Section 11.31, Tax |
|
Code, to the permanent advisory committee established under |
|
Subsection (n) of that section, as amended by this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
