A BILL TO BE ENTITLED
 
AN ACT
  relating to authorization for the appraisal of certain public
  school administrators by educators supervised by the
  administrators.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 21, Education Code, is
  amended by adding Section 21.3541 to read as follows:
         Sec. 21.3541.  APPRAISAL OF ASSISTANT PRINCIPALS AND
  DEPARTMENT HEADS. (a) In addition to the appraisal required under
  this subchapter, the board of trustees of a school district may
  provide an appraisal process and criteria on which to appraise the
  performance of:
               (1)  each school assistant principal by each teacher at
  the school who is the department chair for a subject area or grade
  level; and
               (2)  each teacher who is the department chair for a
  subject area or grade level, on the basis of the teacher's
  performance as department chair, by the other teachers in the
  subject area or at the grade level for which the department chair
  has supervisory responsibilities.
         (b)  An assistant principal or department chair may not be
  appraised under the appraisal process adopted under this section
  more than once each school year.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
