A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the education requirements for certain justices of the |
|
|
peace. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 27.005, Government Code, is amended by |
|
|
adding Subsection (c) to read as follows: |
|
|
(c) If a justice of the peace is responsible for performing |
|
|
inquests under Subchapter A, Chapter 49, Code of Criminal |
|
|
Procedure, or Chapter 50, Code of Criminal Procedure: |
|
|
(1) the course required under Subsection (a)(1) must |
|
|
include at least four hours of training specifically related to the |
|
|
performance of the justice's duties under the applicable provision; |
|
|
and |
|
|
(2) the course required under Subsection (a)(2) must |
|
|
include at least two hours of training specifically related to the |
|
|
performance of the justice's duties under the applicable provision. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
