A BILL TO BE ENTITLED
 
AN ACT
  relating to patient safety plans for certain health care
  facilities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 241, Health and Safety Code, is amended
  by adding Subchapter H to read as follows:
  SUBCHAPTER H.  PATIENT SAFETY PLANS
         Sec. 241.201.  APPLICABILITY OF SUBCHAPTER. This subchapter
  applies to a general or special hospital licensed under this
  chapter or a similar hospital that is maintained or operated by this
  state.
         Sec. 241.202.  PATIENT SAFETY PLAN. A hospital shall adopt
  and implement a patient safety plan based on evidence-based
  protocols.
         Sec. 241.203.  ANNUAL REPORT. (a)  A hospital shall submit
  an annual report to the department that:
               (1)  identifies the protocols that are being used at
  the hospital in accordance with the safety plan adopted under this
  subchapter and describes the protocols in detail; and
               (2)  specifies in which hospital department each
  protocol is used.
         (b)  The report must be submitted on a form prescribed by the
  department.  The department shall specify the reporting date.
         Sec. 241.204.  DEPARTMENTAL SUMMARY. The department shall
  compile a summary of the information submitted under Section
  241.203.  The department shall publish the summary at least
  annually and shall make the summary available on the department's
  Internet website.
         SECTION 2.  Chapter 243, Health and Safety Code, is amended
  by adding Subchapter B to read as follows:
  SUBCHAPTER B.  PATIENT SAFETY PLANS
         Sec. 243.051.  PATIENT SAFETY PLAN. An ambulatory surgical
  center shall adopt and implement a patient safety plan based on
  evidence-based protocols.
         Sec. 243.052.  ANNUAL REPORT. (a)  An ambulatory surgical
  center shall submit an annual report to the department that
  identifies the protocols that are being used at the ambulatory
  surgical center in accordance with the safety plan adopted under
  this subchapter and describes the protocols in detail.
         (b)  The report must be submitted on a form prescribed by the
  department. The department shall specify the reporting date.
         Sec. 243.053.  DEPARTMENTAL SUMMARY. The department shall
  compile a summary of the information submitted under Section
  243.052.  The department shall publish the summary at least
  annually and shall make the summary available on the department's
  Internet website.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
