A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the ability of certain state agencies to seek |
|
injunctions against certain individuals. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Title 2, Occupations Code, is amended by adding |
|
Chapter 60 to read as follows: |
|
CHAPTER 60. CONFLICTS BETWEEN CERTAIN LICENSING AUTHORITIES |
|
Sec. 60.001. DEFINITION. In this chapter, "licensing |
|
authority" means a department, commission, board, office, or other |
|
agency of the state that issues an occupational license for a person |
|
to provide services within the scope of the practice, as defined by |
|
state law, of architecture, land surveying, or professional |
|
engineering. |
|
Sec. 60.002. CERTAIN INJUNCTIONS PROHIBITED. A licensing |
|
authority may not institute an action to enjoin a person licensed by |
|
another licensing authority from engaging in certain conduct if |
|
that conduct has been determined by the licensing authority that |
|
issued the license to be lawful and within the scope of practice |
|
authorized by the person's license. |
|
SECTION 2. This Act takes effect September 1, 2011. |
