A BILL TO BE ENTITLED
 
AN ACT
  relating to the ability of certain state agencies to seek
  injunctions against certain individuals.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Title 2, Occupations Code, is amended by adding
  Chapter 60 to read as follows:
  CHAPTER 60. CONFLICTS BETWEEN CERTAIN LICENSING AUTHORITIES
         Sec. 60.001.  DEFINITION. In this chapter, "licensing
  authority" means a department, commission, board, office, or other
  agency of the state that issues an occupational license for a person
  to provide services within the scope of the practice, as defined by
  state law, of architecture, land surveying, or professional
  engineering.
         Sec. 60.002.  CERTAIN INJUNCTIONS PROHIBITED.  A licensing
  authority may not institute an action to enjoin a person licensed by
  another licensing authority from engaging in certain conduct if
  that conduct has been determined by the licensing authority that
  issued the license to be lawful and within the scope of practice
  authorized by the person's license.
         SECTION 2.  This Act takes effect September 1, 2011.
