A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to municipal prohibition of the use of low-speed vehicles |
|
|
to transport passengers for hire. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 215, Local Government |
|
|
Code, is amended by adding Section 215.005 to read as follows: |
|
|
Sec. 215.005. PROHIBITION ON LOW-SPEED VEHICLES FOR HIRE. |
|
|
(a) In this section, "low-speed vehicle" means a four-wheeled, |
|
|
battery-powered vehicle with a maximum speed of less than 35 miles |
|
|
per hour and a gross weight of less than 3,000 pounds. |
|
|
(b) A municipality shall prohibit in the municipality the |
|
|
use of low-speed vehicles to transport passengers for compensation. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
