A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to requiring health and human services agencies to give |
|
preference to certain persons in making hiring decisions. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter A, Chapter 531, Government Code, is |
|
amended by adding Section 531.0092 to read as follows: |
|
Sec. 531.0092. EMPLOYMENT PREFERENCE. (a) An individual |
|
who received services from a health and human services agency |
|
before the individual's 18th birthday or who is the parent or |
|
caretaker of a child who received services from a health and human |
|
services agency is entitled to a preference in employment with an |
|
agency from which the individual or the individual's child received |
|
services over other applicants for the same position who do not have |
|
greater qualifications. |
|
(b) A health and human services agency shall require an |
|
entity that contracts with the agency to directly provide health |
|
and human services to children and families to give preference in |
|
making hiring decisions to an individual who received services from |
|
the agency before the individual's 18th birthday or who is the |
|
parent or caretaker of a child who received services from the agency |
|
over other applicants for the same position who do not have greater |
|
qualifications. |
|
(c) This section does not apply to: |
|
(1) the position of private secretary or deputy of an |
|
official or department; or |
|
(2) an individual holding a strictly confidential |
|
relationship with the employing officer. |
|
SECTION 2. This Act takes effect September 1, 2011. |
