A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the application requirements for a local project |
|
|
permit. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 245.001, Local Government Code, is |
|
|
amended by amending Subdivision (1) and adding Subdivision (1-a) to |
|
|
read as follows: |
|
|
(1) "Fair notice" means the minimum amount of |
|
|
information necessary to enable a reasonably prudent person to |
|
|
understand the general nature and objective of a project. |
|
|
(1-a) "Permit" means a license, certificate, approval, |
|
|
registration, consent, permit, contract or other agreement for |
|
|
construction related to, or provision of, service from a water or |
|
|
wastewater utility owned, operated, or controlled by a regulatory |
|
|
agency, or other form of authorization required by law, rule, |
|
|
regulation, order, or ordinance that a person must obtain to |
|
|
perform an action or initiate, continue, or complete a project for |
|
|
which the permit is sought. |
|
|
SECTION 2. The changes in law made by this Act to Section |
|
|
245.001, Local Government Code, apply only to an application for a |
|
|
permit submitted for approval on or after the effective date of this |
|
|
Act. An application for a permit submitted for approval before the |
|
|
effective date of this Act is governed by the law in effect when the |
|
|
application was submitted, and the former law is continued in |
|
|
effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
