A BILL TO BE ENTITLED
 
AN ACT
  relating to membership in the structural pest control advisory
  committee.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 1951.101, Occupations Code, is amended
  to read as follows:
         Sec. 1951.101.  COMMITTEE MEMBERSHIP.  (a)  The committee
  consists of nine members appointed by the commissioner as follows:
               [(1)     two members who are experts in structural pest
  control application;
               [(2)(1)  three members who represent the public;
               [(3)     one member from an institution of higher
  education who is knowledgeable in the science of pests and pest
  control;
               [(4)]  (2)  three [one] members who represent[s] the
  interests of structural pest control operators and who are [is]
  appointed based on recommendations provided by a trade association
  of operators;
               [(5)]  (3)  three [one] members who represent[s] the
  interests pest control operators involved in school integrated pest
  management [of consumers; and
               [(6)     the commissioner of state health services or the
  commissioner's designee].
         (b)  Members of the committee serve staggered four-year
  terms. The terms of four or five members, as appropriate, expire on
  February 1 of each odd-numbered year.
         (c)  Service on the committee by a state officer or employee
  is an additional duty of the member's office or employment.
         (d)  Appointments to the committee shall be made without
  regard to the race, color, disability, sex, religion, age, or
  national origin of the appointee.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
