A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to subcontracting opportunities for historically |
|
|
underutilized businesses under certain state purchasing contracts. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2161.253(d), Government Code, is amended |
|
|
to read as follows: |
|
|
(d) If a state agency determination is made that the |
|
|
contractor failed to implement the subcontracting plan in good |
|
|
faith, the agency, in addition to any other remedies, may: |
|
|
(1) consider the contractor's failure to implement the |
|
|
subcontracting plan as substandard performance under the contract |
|
|
when evaluating the contractor's bids in the award of future agency |
|
|
contracts; or |
|
|
(2) bar the contractor from further contracting |
|
|
opportunities with the agency. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
