A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to continuity of retail electric service during the |
|
|
pendency of an appeal of an order revoking the license of a retail |
|
|
electric provider. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter H, Chapter 39, Utilities Code, is |
|
|
amended by adding Section 39.359 to read as follows: |
|
|
Sec. 39.359. BUSINESS TO CONTINUE DURING APPEAL. The |
|
|
commission shall not interrupt the retail electric provider's right |
|
|
to continue conducting business and serving consumers while any |
|
|
review or appeal is pending of an order revoking the provider's |
|
|
certificate. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all members elected to each chamber, as |
|
|
provided by Article III, Section 39 of the Texas Constitution. If |
|
|
this Act does not receive the vote necessary for immediate effect, |
|
|
this Act takes effect September 1, 2011. |
