A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the liability of a midwife in the practice of midwifery. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter H, Chapter 203, Occupations Code, is |
|
|
amended by adding Section 203.358 to read as follows: |
|
|
Sec. 203.358 Statement on Liability Insurance. (a) All |
|
|
licensed midwives must provide to a prospective client before |
|
|
rendering services a form to be signed acknowledging the risks of |
|
|
using a midwife and; |
|
|
(1) that the midwife does carry current medical |
|
|
professional liability insurance coverage or; |
|
|
(2) that the midwife does not currently carry medical |
|
|
professional liability insurance coverage. |
|
|
(b) The Midwifery Board shall prescribe the form for the |
|
|
prospective client. |
|
|
SECTION 2. Not later than November 1, 2011, the Midwifery |
|
|
Board shall prescribe the form required by Section 203.358, |
|
|
Occupations Code, as added by this Act. |
|
|
SECTION 3. (a) Except as provided by Subsection (b) of this |
|
|
section, this Act takes effect September 1, 2011. |
|
|
(b) Section 203.358, Occupations Code, as added by this Act, |
|
|
takes effect January 1, 2012. |
