A BILL TO BE ENTITLED
 
AN ACT
  relating to the liability of a midwife in the practice of midwifery.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 203, Occupations Code, is
  amended by adding Section 203.358 to read as follows:
         Sec. 203.358  Statement on Liability Insurance.  (a)  All
  licensed midwives must provide to a prospective client before
  rendering services a form to be signed acknowledging the risks of
  using a midwife and;
               (1)  that the midwife does carry current medical
  professional liability insurance coverage or;
               (2)  that the midwife does not currently carry medical
  professional liability insurance coverage.
         (b)  The Midwifery Board shall prescribe the form for the
  prospective client.
         SECTION 2.  Not later than November 1, 2011, the Midwifery
  Board shall prescribe the form required by Section 203.358,
  Occupations Code, as added by this Act.
         SECTION 3.  (a) Except as provided by Subsection (b) of this
  section, this Act takes effect September 1, 2011.
         (b)  Section 203.358, Occupations Code, as added by this Act,
  takes effect January 1, 2012.
