A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to deferral of certain surcharge payments for active duty |
|
|
military personnel. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 708.103, Transportation Code, is amended |
|
|
by adding Subsection (c) to read as follows: |
|
|
(c) The department by rule shall establish a deferral |
|
|
program for surcharges assessed against a person who is on active |
|
|
duty in the United States armed forces. The program must: |
|
|
(1) toll the 36-month period while the person is on |
|
|
active duty; and |
|
|
(2) defer assessment of surcharges under this section |
|
|
against the person on active duty until the date the person is no |
|
|
longer on active duty for an offense committed: |
|
|
(A) before the person was on active duty; or |
|
|
(B) while the person is on active duty. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
