          AN ACT

        relating to a disciplinary proceeding for a professional employee  |

        of a school district based on the employee's use of physical force  | 
      
      
        | 
           
			 | 
        against a student. | 
      
      
        | 
           
			 | 
               BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | 
      
      
        | 
           
			 | 
               SECTION 1.  Section 22.0512(a), Education Code, is amended  | 
      
      
        | 
           
			 | 
        to read as follows: | 
      
      
        | 
           
			 | 
               (a)  A professional employee of a school district may not be  | 
      
      
        | 
           
			 | 
        subject to disciplinary proceedings for the employee's objectively  | 
      
      
        | 
           
			 | 
        reasonable use of physical force against a student to the extent  | 
      
      
        | 
           
			 | 
        justified under Section 9.62, Penal Code. | 
      
      
        | 
           
			 | 
               SECTION 2.  This Act applies only to a school district  | 
      
      
        | 
           
			 | 
        employee disciplinary proceeding for conduct that occurs on or  | 
      
      
        | 
           
			 | 
        after the effective date of this Act. A school district employee  | 
      
      
        | 
           
			 | 
        disciplinary proceeding for conduct that occurs before the  | 
      
      
        | 
           
			 | 
        effective date of this Act is governed by the law in effect on the  | 
      
      
        | 
           
			 | 
        date the conduct occurs, and that law is continued in effect for  | 
      
      
        | 
           
			 | 
        that purpose. | 
      
      
        | 
           
			 | 
               SECTION 3.  This Act takes effect September 1, 2011. |
