A BILL TO BE ENTITLED
 
AN ACT
  relating to duties of law enforcement involving damaged fences.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 370.004(a), Local Government Code, is
  amended to read as follows:
         (a)  A peace officer employed by a political subdivision of
  this state who investigates or responds to an incident in which a
  motor vehicle damages a fence shall, if the peace officer
  reasonably believes that the fence is intended to contain livestock
  or other animals:
               (1)  immediately determine the owner of the land on
  which the damaged fence is located; [and]
               (2)  notify the owner of the type and extent of the
  damage, if the owner has registered with the political subdivision
  in accordance with Subsection (c); and
               (3)  remain at the location of the damaged fence until:
                     (A)  the peace officer or another person makes
  reasonable attempts to secure the fence; or
                     (B)  the landowner or landowner's representative
  arrives at the scene.
         SECTION 2.  This Act takes effect September 1, 2011.
