A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to duties of law enforcement involving damaged fences. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 370.004(a), Local Government Code, is |
|
amended to read as follows: |
|
(a) A peace officer employed by a political subdivision of |
|
this state who investigates or responds to an incident in which a |
|
motor vehicle damages a fence shall, if the peace officer |
|
reasonably believes that the fence is intended to contain livestock |
|
or other animals: |
|
(1) immediately determine the owner of the land on |
|
which the damaged fence is located; [and] |
|
(2) notify the owner of the type and extent of the |
|
damage, if the owner has registered with the political subdivision |
|
in accordance with Subsection (c); and |
|
(3) remain at the location of the damaged fence until: |
|
(A) the peace officer or another person makes |
|
reasonable attempts to secure the fence; or |
|
(B) the landowner or landowner's representative |
|
arrives at the scene. |
|
SECTION 2. This Act takes effect September 1, 2011. |
