A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the collection of data related to health benefit plan |
|
|
claims for the treatment of a child's serious mental illness. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter F, Chapter 38, Insurance Code, is |
|
|
amended by adding Section 38.2521 to read as follows: |
|
|
Sec. 38.2521. DATA RELATED TO CHILD'S SERIOUS MENTAL |
|
|
ILLNESS. (a) In addition to the requirements of Section 38.252, |
|
|
the commissioner by rule shall require health benefit plan issuers, |
|
|
including the Employees Retirement System of Texas and the Teacher |
|
|
Retirement System of Texas, to report to the department the number, |
|
|
type, and geographic location of claims for the treatment of a |
|
|
serious mental illness of a child younger than 18 years of age. |
|
|
(b) The department shall compile statistics from the |
|
|
information reported under this section and make the statistics |
|
|
available on the department's Internet website in a user-friendly |
|
|
format. |
|
|
(c) The commissioner may not require reporting of data: |
|
|
(1) that could reasonably be used to identify a |
|
|
specific enrollee in a health benefit plan; or |
|
|
(2) that in any way violates confidentiality |
|
|
requirements of state or federal law applicable to an enrollee in a |
|
|
health benefit plan. |
|
|
SECTION 2. The commissioner of insurance may not require |
|
|
reporting under Section 38.2521, Insurance Code, as added by this |
|
|
Act, with respect to claims for the treatment of a child's serious |
|
|
mental illness made before January 1, 2012. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
