A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the annual reporting of groundwater use in activities |
|
|
related to the exploration or drilling for or production of oil or |
|
|
gas by owners or operators of oil and gas wells. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter E, Chapter 91, Natural Resources |
|
|
Code, is amended by adding Section 91.1421 to read as follows: |
|
|
Sec. 91.1421. ANNUAL REPORT OF GROUNDWATER USE. (a) In |
|
|
this section, "groundwater" has the meaning assigned by Section |
|
|
36.001, Water Code. |
|
|
(b) An owner or operator who is engaged in the exploration |
|
|
or drilling for or production of oil or gas shall: |
|
|
(1) maintain an accounting of the amount of |
|
|
groundwater used by the owner or operator in the exploration or |
|
|
drilling for or production of oil or gas; and |
|
|
(2) submit to the commission, the Texas Commission on |
|
|
Environmental Quality, and the Texas Water Development Board an |
|
|
annual report of the amount of groundwater used by the owner or |
|
|
operator in the exploration or drilling for or production of oil or |
|
|
gas in the preceding year. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
