A BILL TO BE ENTITLED
 
AN ACT
  relating to the confidentiality of certain communications and
  records made or collected in reference to certain sexual assault
  survivors.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Article 56.065, Code of Criminal Procedure, is
  amended by adding Subsection (j) to read as follows:
         (j)  A communication or record that contains identifying
  information regarding a person who receives a forensic medical
  examination under this article and that is created by, provided to,
  or in the control or possession of the department is confidential
  for purposes of Section 552.101, Government Code. In this
  subsection, "identifying information" includes:
               (1)  information revealing the identity, personal
  history, or background of the person; or
               (2)  information concerning the victimization of the
  person.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
