A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the posting of public notice of the issuance of a permit |
|
|
for an oil or gas well by the operator of the well. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Q, Chapter 91, Natural Resources |
|
|
Code, is amended by adding Section 91.7545 to read as follows: |
|
|
Sec. 91.7545. POSTING OF SIGN. In addition to giving notice |
|
|
as required by Sections 91.753 and 91.754, the operator shall, not |
|
|
later than the deadline for giving notice under Section 91.753, |
|
|
post in a conspicuous location on the tract of land on which the |
|
|
well is located or is proposed to be located a sign that: |
|
|
(1) gives notice of the issuance of the permit; |
|
|
(2) states the name of: |
|
|
(A) the owner of the property; and |
|
|
(B) the operator of the well; |
|
|
(3) is written in the English language; |
|
|
(4) has letters of at least one inch in height; and |
|
|
(5) is readily visible to a person approaching the |
|
|
property. |

|
SECTION 2. The change in law made by this Act applies only |
|
|
to notice of the issuance of a permit issued on or after the |
|
|
effective date of this Act. Notice of the issuance of a permit |
|
|
issued before the effective date of this Act is governed by the law |
|
|
as it existed on the date the permit was issued, and the former law |
|
|
is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
