A BILL TO BE ENTITLED
 
AN ACT
  relating to the issuance of a permit for the operation of certain
  overweight vehicle combinations.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 623, Transportation Code, is amended by
  adding Subchapter B-1 to read as follows:
  SUBCHAPTER B-1. ANNUAL OVERWEIGHT PERMIT
         Sec. 623.021.  ANNUAL OVERWEIGHT PERMIT. (a) In this
  section, "commercial motor vehicle," "semitrailer," "trailer," and
  "vehicle" have the meanings assigned by Section 621.001.
         (b)  The department may issue a permit that authorizes the
  operation of a combination of a commercial motor vehicle and a
  loaded trailer or semitrailer:
               (1)  at an axle weight that is not heavier than the
  weight equal to the maximum allowable axle weight for the vehicle or
  combination plus a tolerance allowance of 10 percent of that
  allowable weight; and
               (2)  at a gross weight that is not heavier than 92,000
  pounds.
         (c)  To qualify for a permit under this section:
               (1)  the vehicle combination must include a total of
  six or more axles; and
               (2)  an applicant for the permit must pay a permit fee
  of $5,000 to the department.
         (d)  A permit issued under this section:
               (1)  is valid for one year; and
               (2)  must be carried in the vehicle for which it is
  issued.
         (e)  The Texas Transportation Commission shall adopt rules
  as necessary to implement this section.
         SECTION 2.  This Act takes effect September 1, 2011.
