A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the issuance of a permit for the operation of certain |
|
|
overweight vehicle combinations. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 623, Transportation Code, is amended by |
|
|
adding Subchapter B-1 to read as follows: |
|
|
SUBCHAPTER B-1. ANNUAL OVERWEIGHT PERMIT |
|
|
Sec. 623.021. ANNUAL OVERWEIGHT PERMIT. (a) In this |
|
|
section, "commercial motor vehicle," "semitrailer," "trailer," and |
|
|
"vehicle" have the meanings assigned by Section 621.001. |
|
|
(b) The department may issue a permit that authorizes the |
|
|
operation of a combination of a commercial motor vehicle and a |
|
|
loaded trailer or semitrailer: |
|
|
(1) at an axle weight that is not heavier than the |
|
|
weight equal to the maximum allowable axle weight for the vehicle or |
|
|
combination plus a tolerance allowance of 10 percent of that |
|
|
allowable weight; and |
|
|
(2) at a gross weight that is not heavier than 92,000 |
|
|
pounds. |
|
|
(c) To qualify for a permit under this section: |
|
|
(1) the vehicle combination must include a total of |
|
|
six or more axles; and |
|
|
(2) an applicant for the permit must pay a permit fee |
|
|
of $5,000 to the department. |
|
|
(d) A permit issued under this section: |
|
|
(1) is valid for one year; and |
|
|
(2) must be carried in the vehicle for which it is |
|
|
issued. |
|
|
(e) The Texas Transportation Commission shall adopt rules |
|
|
as necessary to implement this section. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
