A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to anesthesia services provided by a dentist. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. The heading to Subchapter D, Chapter 258, |
|
Occupations Code, is amended to read as follows: |
|
SUBCHAPTER D. [ENTERAL] ADMINISTRATION OF ANESTHESIA |
|
SECTION 2. Subchapter D, Chapter 258, Occupations Code, is |
|
amended by adding Section 258.158 to read as follows: |
|
Sec. 258.158. PORTABILITY OF DEEP SEDATION ANESTHESIA |
|
SERVICES. (a) In this section: |
|
(1) "Deep sedation" means a drug-induced depression of |
|
consciousness during which a patient cannot be easily aroused but |
|
responds purposefully following repeated or painful stimulation. |
|
(2) "Portability" means, with respect to anesthesia |
|
services, the ability of a dentist who holds a permit under this |
|
subchapter to provide anesthesia services in a location other than |
|
a facility or satellite facility. |
|
(b) To qualify for a permit that grants the portability of |
|
deep sedation anesthesia services, a dentist must complete at least |
|
24 months of training in the use and administration of deep sedation |
|
anesthesia. |
|
SECTION 3. (a) Not later than January 1, 2012, the State |
|
Board of Dental Examiners shall adopt the rules necessary to |
|
implement the changes in law made by this Act. |
|
(b) Section 258.158, Occupations Code, as added by this Act, |
|
applies only to a permit issued on or after March 1, 2012. A permit |
|
issued before March 1, 2012, is governed by the law in effect when |
|
the permit was issued, and the former law is continued in effect for |
|
that purpose. |
|
SECTION 4. This Act takes effect September 1, 2011. |
