A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to venue for certain crimes against children. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 13, Code of Criminal Procedure, is |
|
|
amended by adding Article 13.075 to read as follows: |
|
|
Art. 13.075. CHILD INJURED IN ONE COUNTY AND RESIDING IN |
|
|
ANOTHER. An offense under Title 5, Penal Code, involving a victim |
|
|
younger than 18 years of age may be prosecuted in the county: |
|
|
(1) in which the offense was committed; |
|
|
(2) in which the defendant is apprehended; |
|
|
(3) in which the victim resides; |
|
|
(4) in which the defendant resides; or |
|
|
(5) to which the defendant is extradited. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an offense committed on or after the effective date of this Act. |
|
|
An offense committed before the effective date of this Act is |
|
|
governed by the law in effect on the date the offense was committed, |
|
|
and the former law is continued in effect for that purpose. For |
|
|
purposes of this section, an offense was committed before the |
|
|
effective date of this Act if any element of the offense occurred |
|
|
before that date. |

|
SECTION 3. This Act takes effect September 1, 2011. |
