A BILL TO BE ENTITLED
 
AN ACT
  relating to an election to authorize an increase in a school
  district superintendent's salary.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter I, Chapter 21, Education Code, is
  amended by adding Section 21.416 to read as follows:
         Sec. 21.416.  VOTER APPROVAL REQUIRED FOR SUPERINTENDENT
  SALARY INCREASE. (a) The board of trustees of a school district
  may not increase the salary of the district superintendent unless a
  majority of the voters in the district voting in an election approve
  the increase.
         (b)  The board of trustees of a school district that proposes
  a salary increase for the district superintendent shall order that
  an appropriate proposition be placed on the ballot at the first
  regular election of trustees held after the date the board proposes
  the increase. The proposition must specify the amount of the
  proposed salary and the proposed percentage increase.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
