A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to information on the number of calories in certain foods |
|
|
offered by public schools to students. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 12, Agriculture Code, is amended by |
|
|
adding Section 12.0023 to read as follows: |
|
|
Sec. 12.0023. INFORMATION ON NUMBER OF CALORIES IN PUBLIC |
|
|
SCHOOL MEALS. (a) Each school day a public school shall |
|
|
prominently post at or near the point at which public school |
|
|
breakfasts and lunches are selected by or otherwise offered to |
|
|
students a listing of the number of calories: |
|
|
(1) in each menu item, including each beverage, that |
|
|
is offered as part of that day's breakfast or lunch meal; and |
|
|
(2) in any other food or beverage item, including each |
|
|
snack item, that is not part of a breakfast or lunch meal but that is |
|
|
regularly sold or otherwise offered to students by the school. |
|
|
(b) A school district shall, before the beginning of each |
|
|
school day, post on the district's Internet website for each |
|
|
district school the information posted under Subsection (a). |
|
|
(c) The department shall adopt rules to administer this |
|
|
section. |
|
|
SECTION 2. This Act applies beginning with the 2011-2012 |
|
|
school year. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
