A BILL TO BE ENTITLED
 
AN ACT
  relating to information on the number of calories in certain foods
  offered by public schools to students.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 12, Agriculture Code, is amended by
  adding Section 12.0023 to read as follows:
         Sec. 12.0023.  INFORMATION ON NUMBER OF CALORIES IN PUBLIC
  SCHOOL MEALS. (a) Each school day a public school shall
  prominently post at or near the point at which public school
  breakfasts and lunches are selected by or otherwise offered to
  students a listing of the number of calories:
               (1)  in each menu item, including each beverage, that
  is offered as part of that day's breakfast or lunch meal; and
               (2)  in any other food or beverage item, including each
  snack item, that is not part of a breakfast or lunch meal but that is
  regularly sold or otherwise offered to students by the school.
         (b)  A school district shall, before the beginning of each
  school day, post on the district's Internet website for each
  district school the information posted under Subsection (a).
         (c)  The department shall adopt rules to administer this
  section.
         SECTION 2.  This Act applies beginning with the 2011-2012
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
