A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to state contribution to the cost of certain dependents' |
|
|
participation in the group benefits program for state employees and |
|
|
their dependents. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1551.310, Insurance Code, is amended to |
|
|
read as follows: |
|
|
Sec. 1551.310. STATE CONTRIBUTION REQUIRED. (a) Subject to |
|
|
Subsection (b), the [The] state shall contribute to the cost of each |
|
|
participant's group coverages, including dependents' group |
|
|
coverages, the amounts appropriated for the coverages in the |
|
|
General Appropriations Act. |
|
|
(b) The state may not contribute more than 90 percent of the |
|
|
amount that the state contributes for the group coverage of a |
|
|
dependent under Subsection (a) for a spouse who participates in the |
|
|
group benefits program in lieu of participating in another health |
|
|
benefit plan in which the spouse is eligible to participate, |
|
|
including a health benefit plan offered by the spouse's employer. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to group coverage provided under Chapter 1551, Insurance Code, for |
|
|
a plan year beginning on or after September 1, 2011. A plan year |
|
|
that begins before that date is governed by the law as it existed |
|
|
immediately before the effective date of this Act, and that law is |
|
|
continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
