A BILL TO BE ENTITLED
 
AN ACT
  relating to notice provided to certain local officials regarding
  the use of land application to treat and dispose of certain oil and
  gas waste.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 91, Natural Resources
  Code, is amended by adding Section 91.118 to read as follows:
         Sec. 91.118.  NOTIFICATION OF LAND APPLICATION OF CERTAIN
  WASTE. If the commission adopts rules requiring a permit to use
  land application to treat and dispose of oil field fluids or oil and
  gas wastes, the commission by rule shall require a person who files
  an application for a permit to provide written notice to:
               (1)  each groundwater conservation district in the area
  in which the land application will occur;
               (2)  the mayor of each municipality in the area in which
  the land application will occur; and
               (3)  the county judge of each county in the area in
  which the land application will occur.
         SECTION 2.  Section 91.118, Natural Resources Code, as added
  by this Act, applies only to an application for a permit to use land
  application to treat and dispose of oil field fluids or oil and gas
  wastes that is filed with the Railroad Commission of Texas on or
  after the effective date of this Act.  An application for a permit
  that was filed with the commission before the effective date of this
  Act is governed by the law as it existed on the date the application
  was filed, and that law is continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2011.
