A BILL TO BE ENTITLED
 
AN ACT
  relating to the applicability of cumulative voting for the board of
  trustees of certain independent school districts.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 11.065, Education Code, is amended by
  adding Subsection (e) to read as follows:
         (e)  Section 11.054 does not apply to the board of trustees
  of the smallest school district located in a county located on the
  Texas-Mexico border that has a population greater than 700,000 and
  whose largest municipality has a population of less than 150,000.
         SECTION 2.  The change in law made by this Act applies only
  to the election of a member of a board of trustees of an independent
  school district who is elected on or after the effective date of
  this Act.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
