A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to rules adopted by the commissioner of insurance |
|
|
regulating the manufacture, transportation, storage, and retail |
|
|
sales of fireworks. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2154.052(d), Occupations Code, is |
|
|
amended to read as follows: |
|
|
(d) In adopting a rule, the commissioner: |
|
|
(1) shall use the National Fire Protection Association |
|
|
standard "NFPA 1124: Code for the Manufacturing, Transportation, |
|
|
Storage and Retail Sale of Fireworks and Pyrotechnic Articles, 2006 |
|
|
Edition"; and |
|
|
(2) may use standards recognized by federal law or |
|
|
regulation and standards published by a nationally recognized |
|
|
standards-making organization. |
|
|
SECTION 2. The change in law made by this Act to Section |
|
|
2154.052(d), Occupations Code, applies to a rule adopted by the |
|
|
commissioner of insurance on or after the effective date of this |
|
|
Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
