A BILL TO BE ENTITLED
 
AN ACT
  relating to state administration of certain assessment instruments
  to public school students.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 39.022, Education Code, is amended to
  read as follows:
         Sec. 39.022.  ASSESSMENT PROGRAM.  The State Board of
  Education by rule shall create and implement a statewide assessment
  program that is knowledge- and skills-based to ensure school
  accountability for student achievement that achieves the goals
  provided under Section 4.002.  The board may adopt rules to the
  extent necessary for the administration of the assessment program
  in accordance with this subchapter.  [After adopting rules under
  this section, the State Board of Education shall consider the
  importance of maintaining stability in the statewide assessment
  program when adopting any subsequent modification of the rules.]
         SECTION 2.  Sec. 39.023(a), (b), (c), (c-1), (c-2), (c-3),
  (c-4), (c-5), and (c-6) Education Code, are repealed.
         SECTION 3.  Sec. 39.0231 Education Code, is repealed.
         SECTION 4.  Sec. 39.0232 Education Code, is repealed.
         SECTION 5.  Sec. 39.0233 Education Code, is repealed.
         SECTION 6.  Sec. 39.02324 Education Code, is repealed.
         SECTION 7.  Sec. 39.024(a), (b), (c), (d), (e), (f), (f-1),
  (g), (h), and (i) Education Code, are repealed.
         SECTION 8.  Sec. 39.0241 Education Code, is repealed.
         SECTION 9.  Sec. 39.0242 Education Code, is repealed.
         SECTION 10.  Sec. 39.025 Education Code, is repealed.
         SECTION 11.  Sec. 39.0262 Education Code, is repealed.
         SECTION 12.  Sec. 39.027 Education Code, is repealed.
         SECTION 13.  As of the effective date of this Act, the Texas
  Education Agency may not perform research or development concerning
  assessment instruments under Subchapter B, Chapter 39, Education
  Code, as that subchapter existed before amendment by this Act prior
  to September 1, 2013.
         SECTION 14.  Not later than October 1, 2012, the Texas
  Education Agency shall apply to the United States Department of
  Education for any waiver necessary to implement, in compliance with
  federal law and regulations, Subchapter B, Chapter 39, Education
  Code, as amended by this Act.
         SECTION 15.  This Act applies beginning with the 2011-2012
  school year.
         SECTION 16.  This Act takes effect immediately if it
  receives a vote of two-thirds of all the members elected to each
  house, as provided by Section 39, Article III, Texas Constitution.  
  If this Act does not receive the vote necessary for immediate
  effect, this Act takes effect September 1, 2011.
