A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the provision of certain prescription medications to a |
|
|
foster child. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 226, Family Code, is |
|
|
amended by adding Section 266.0042 to read as follows: |
|
|
Sec. 266.0042. PRESCRIPTION MEDICATION REQUIREMENTS. (a) |
|
|
Except in the case of an emergency, a foster child may not be |
|
|
prescribed more than four prescription medications to be taken |
|
|
concurrently unless the decision to prescribe the medications is |
|
|
reviewed and approved by an independent physician provided by the |
|
|
managed care organization providing health care services to the |
|
|
child under the STAR Health program. |
|
|
(b) The department shall maintain a record of all |
|
|
medications prescribed for a child in the conservatorship of the |
|
|
department. The record must include, for each medication, the name |
|
|
of the medication, the dosage amount, and the frequency with which |
|
|
the child is to receive the medication. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
