A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a prohibition on the marketing of foods of minimal |
|
nutritional value on public school campuses. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 12, Agriculture Code, is amended by |
|
adding Section 12.0022 to read as follows: |
|
Sec. 12.0022. PROHIBITION ON MARKETING OF FOODS OF MINIMAL |
|
NUTRITIONAL VALUE ON PUBLIC SCHOOL CAMPUSES. (a) A public school |
|
may not market or permit any other person to market a food of |
|
minimal nutritional value on the school campus. |
|
(b) The department shall adopt rules as necessary for the |
|
administration of this section. The rules must identify or |
|
establish criteria for identifying foods of minimal nutritional |
|
value. |
|
SECTION 2. As soon as practicable after the effective date |
|
of this Act, the Department of Agriculture shall adopt rules for the |
|
administration of Section 12.0022, Agriculture Code, as added by |
|
this Act. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
