A BILL TO BE ENTITLED
 
AN ACT
  relating to the reporting of information by a school district
  relating to certain offenses committed by certain students.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 37, Education Code, is
  amended by adding Section 37.023 to read as follows:
         Sec. 37.023.  REPORT RELATING TO CERTAIN OFFENSES COMMITTED
  BY CERTAIN STUDENTS. (a) In the manner required by the
  commissioner, each school district shall annually report to the
  commissioner information relating to an offense that does not
  involve the use of a weapon:
               (1)  committed by a student who is younger than 12 years
  of age, during regular school hours, and on school property; and
               (2)  for which the student receives a citation.
         (b)  Conduct that must be reported under Subsection (a)
  includes only conduct that:
               (1)  is not harassment as defined by Section 37.001;
               (2)  occurs between two students;
               (3)  is not violent;
               (4)  involves open-handed physical contact; and
               (5)  is not intended to cause harm and is playful.
         (c)  The report required under Subsection (a) must include:
               (1)  the offense committed by the student;
               (2)  the age and sex of the student;
               (3)  the race or ethnicity of the student;
               (4)  the grade level of the student; and
               (5)  the campus to which the student is assigned.
         (d)  The commissioner may adopt rules necessary to implement
  this section.
         SECTION 2.  This Act applies beginning with the 2011-2012
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
