A BILL TO BE ENTITLED
 
AN ACT
  relating to truancy and the jurisdiction of justice courts
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 45, Code of Criminal
  Procedures, is amended by striking:
         Art. 45.054.  FAILURE TO ATTEND SCHOOL PROCEEDINGS.  (A)  
  Attend school without unexcused absences.
         SECTION 2.  Section 25.094, Chapter 25, Education Code, is
  amended by adding:
         (a)(2)  fails to attend school on 12 10 or more days or parts
  of days within a six-month period in the same school year or on
  three or more days or parts of days within a four-week period.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
