A BILL TO BE ENTITLED
 
AN ACT
 
  relating to a limitation on production fees on groundwater
  withdrawals assessed by the Northern Trinity Groundwater
  Conservation District.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter E, Chapter 8820, Special District
  Local Laws Code, is amended by adding Section 8820.202 to read as
  follows:
         Sec. 8820.202.  LIMITATION ON ASSESSMENT OF PRODUCTION FEES.
  A production fee assessed by the district on the amount of
  groundwater authorized by a permit to be withdrawn from a well or
  the amount of groundwater actually withdrawn may not exceed:
               (1)  $1 for each acre-foot of groundwater permitted for
  or used in a year solely for agricultural use; or
               (2)  20 cents for each 1,000 gallons of groundwater
  permitted for or used in a year for any purpose other than
  agriculture.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
