A JOINT RESOLUTION
|
|
proposing a constitutional amendment authorizing garnishment of |
|
wages for the recovery of fraudulently obtained unemployment |
|
benefits or of taxes or fees owed to the state. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 28, Article XVI, Texas Constitution, is |
|
amended to read as follows: |
|
Sec. 28. No current wages for personal service shall ever be |
|
subject to garnishment, except for: |
|
(1) the enforcement of court-ordered: |
|
(A) [(1)] child support payments; or |
|
(B) [(2)] spousal maintenance; or |
|
(2) the recovery of: |
|
(A) fraudulently obtained unemployment benefits; |
|
or |
|
(B) taxes or fees owed to the state. |
|
SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 8, 2011. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment authorizing |
|
garnishment of wages for the recovery of fraudulently obtained |
|
unemployment benefits or of taxes or fees owed to the state." |
