A JOINT RESOLUTION
|
|
proposing a constitutional amendment authorizing the legislature |
|
to legalize and regulate the conduct of gaming in this state and |
|
authorizing the conduct of gaming by certain federally recognized |
|
Indian tribes. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subsection (a), Section 47, Article III, Texas |
|
Constitution, is amended to read as follows: |
|
(a) The Legislature shall pass laws prohibiting lotteries |
|
and gift enterprises in this State other than those authorized by |
|
Subsections (b), (d), and (e) of this section and Section 47a of |
|
this article. |
|
SECTION 2. Article III, Texas Constitution, is amended by |
|
adding Section 47a to read as follows: |
|
Sec. 47a. (a) The legislature may by general law authorize |
|
and regulate the conduct of one or more types of gaming activity, |
|
including slot machines or any other game of chance or similar |
|
activity, at specific locations as provided by law, including |
|
greyhound or horse race racetracks, destination resort casinos, or |
|
the tribal lands of federally recognized Indian tribes. The |
|
legislature may condition the approval of a gaming activity |
|
authorized by this subsection in a defined area of the state on the |
|
approval of the activity at a local option election held in the |
|
area. |
|
(b) The legislature shall establish a state agency to |
|
administer any gaming activity authorized by Subsection (a) of this |
|
section. |
|
(c) The legislature may provide by general law for the |
|
dedication of revenues received by the state or a local government |
|
from a gaming activity authorized by this section. |
|
SECTION 3. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 8, 2011. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment authorizing the |
|
legislature to legalize and regulate the conduct of gaming in this |
|
state and authorizing the conduct of gaming by certain federally |
|
recognized Indian tribes." |
