R E S O L U T I O N
|
|
|
BE IT RESOLVED by the House of Representatives of the State of |
|
Texas, 82nd Legislature, Regular Session, 2011, That House Rule 13, |
|
Section 9(a), be suspended in part as provided by House Rule 13, |
|
Section 9(f), to enable the conference committee appointed to |
|
resolve the differences on House Bill 2694 (continuation and |
|
functions of the Texas Commission on Environmental Quality), to |
|
consider and take action on the following matter: |
|
House Rule 13, Section 9(a)(1), is suspended to permit the |
|
committee to change text not in disagreement in proposed Section |
|
6.03 of the bill, in amended Section 5.701(n)(1), Water Code, to |
|
read as follows: |
|
(1) Each provider of potable water or sewer utility |
|
service shall collect a regulatory assessment from each retail |
|
customer as follows: |
|
(A) A public utility as defined in Section 13.002 |
|
[of this code] shall collect from each retail customer a regulatory |
|
assessment equal to one percent of the charge for retail water or |
|
sewer service. |
|
(B) A water supply or sewer service corporation |
|
as defined in Section 13.002 [of this code] shall collect from each |
|
retail customer a regulatory assessment equal to one-half of one |
|
percent of the charge for retail water or sewer service. |
|
(C) A district as defined in Section 49.001 [of
|
|
this code] that provides potable water or sewer utility service to |
|
retail customers shall collect from each retail customer a |
|
regulatory assessment equal to one-half of one percent of the |
|
charge for retail water or sewer service. |
|
Explanation: This change is necessary to remove a change to |
|
the regulatory assessment collected by certain water supply or |
|
sewer service corporations. |
