A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to disclosure by the Texas Commission on Environmental |
|
|
Quality of information related to emissions events. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 382.0215, Health and Safety Code, is |
|
|
amended by adding Subsections (b-1) and (e-1) to read as follows: |
|
|
(b-1) After receiving a report of an emissions event under |
|
|
Subsection (b)(2), the commission shall provide notice of the event |
|
|
to officials who represent the area in which the event occurred, |
|
|
including: |
|
|
(1) each state senator; |
|
|
(2) each state representative; |
|
|
(3) the county commissioners court; and |
|
|
(4) if applicable, the mayor or other presiding |
|
|
officer of any affected municipality. |
|
|
(e-1) The commission shall maintain a list of emissions |
|
|
events on the commission's Internet website that is easily |
|
|
accessible by the public and that includes information on emissions |
|
|
events that have occurred in the preceding 12 weeks. The |
|
|
information must include: |
|
|
(1) the name of the regulated entity; |
|
|
(2) each air contaminant emitted; |
|
|
(3) the location of the emissions event; and |
|
|
(4) the date and duration of the event. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
