A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the amount of the permit fee for an on-site sewage |
|
|
disposal system. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 366.058, Health and Safety Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) If the commission delegates to an authorized agent the |
|
|
authority to establish the amount of a permit fee under Subsection |
|
|
(a), the amount of the fee established by the authorized agent may |
|
|
not exceed the amount for a similar permit issued by the commission. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to the fee for a permit the application for which is submitted to an |
|
|
authorized agent under Chapter 366, Health and Safety Code, on or |
|
|
after the effective date of this Act. The fee for a permit the |
|
|
application for which is submitted to an authorized agent under |
|
|
that chapter before the effective date of this Act is governed by |
|
|
the law in effect at the time the application was submitted, and the |
|
|
former law is continued in effect for that purpose. |

|
SECTION 3. This Act takes effect September 1, 2011. |
