A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the extent of extraterritorial jurisdiction of certain |
|
less populous municipalities located on a barrier island. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 42.021, Local Government Code, is |
|
amended by amending Subsection (b) and adding Subsection (c) to |
|
read as follows: |
|
(b) Regardless of Subsection (a), the extraterritorial |
|
jurisdiction of a municipality is the unincorporated area that is |
|
contiguous to the corporate boundaries of the municipality and that |
|
is located: |
|
(1) within five miles of those boundaries on a [the] |
|
barrier island; or |
|
(2) within one-half mile of those boundaries off a |
|
barrier island. |
|
(c) Subsection (b) applies to a [if the] municipality that |
|
has: |
|
(1) a population of 2,000 or more; and |
|
(2) territory located: |
|
(A) entirely on a barrier island in the Gulf of |
|
Mexico; and |
|
(B) within 30 miles of an international border. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
