A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a credit against the access fee for a private dock |
|
|
charged by the Brazos River Authority in the event of a drought. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 8502, Special District Local Laws Code, |
|
|
is amended by adding Section 8502.0125 to read as follows: |
|
|
Sec. 8502.0125. CREDIT AGAINST ACCESS FEE FOR PRIVATE DOCK |
|
|
IN EVENT OF DROUGHT. If the authority charges an access fee for a |
|
|
private dock located on a lake maintained and operated by the |
|
|
authority and the level of the lake is too low because of a drought |
|
|
for the dock to provide access to the lake during any part of the |
|
|
year for which the fee is charged, the authority shall credit |
|
|
against the fee charged for the dock in the following year an amount |
|
|
computed by multiplying the amount of the fee charged in the |
|
|
preceding year by a fraction representing the part of the preceding |
|
|
year in which the level of the lake was too low because of a drought |
|
|
for the dock to provide access to the lake. |
|
|
SECTION 2. This Act takes effect January 1, 2012. |
