AN ACT
|
|
relating to allowing the Aransas County Commissioners Court to |
|
charge interest on assessments for certain county road |
|
improvements. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. This Act is enacted under the authority of the |
|
legislature to pass local laws for the maintenance of public roads |
|
and highways under Subsection (e), Section 9, Article VIII, Texas |
|
Constitution. |
|
SECTION 2. Section 253.008, Transportation Code, is amended |
|
by amending Subsection (b) and adding Subsection (d) to read as |
|
follows: |
|
(b) Except as provided by Subsection (d), the [The] |
|
commissioners court may not require the payment of interest on an |
|
assessment. |
|
(d) Beginning on the second anniversary of the date of an |
|
assessment, the Commissioners Court of Aransas County by order may |
|
require the payment of interest on the assessment at the rate |
|
determined under Section 304.003, Finance Code. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
