A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to notice provided to affected landowners of applications |
|
|
for transmission line certificates of convenience and necessity by |
|
|
electric utilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 37.054, Utilities Code, is amended by |
|
|
adding Subsection (a-1) to read as follows: |
|
|
(a-1) In addition to the notice required under Subsection |
|
|
(a)(1), the commission by rule shall require the applicant to |
|
|
provide to each owner of land that would be affected notice by |
|
|
certified mail of an application to obtain or amend a certificate |
|
|
for the construction of a transmission line. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an application for a certificate of convenience and necessity |
|
|
filed on or after the effective date of this Act. An application |
|
|
for a certificate filed before the effective date of this Act is |
|
|
governed by the law in effect on the date the application was filed, |
|
|
and that law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
