A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the provision of legal services by a guardian in |
|
|
connection with a guardianship. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subpart F, Part 4, Chapter XIII, Texas Probate |
|
|
Code, is amended by adding Section 773A to read as follows: |
|
|
Sec. 773A. GUARDIAN PROVIDING LEGAL SERVICES FOR WARD |
|
|
PROHIBITED. An attorney who serves as guardian may not provide |
|
|
legal services in connection with the guardianship. |
|
|
SECTION 2. Section 665D, Texas Probate Code, is repealed. |
|
|
SECTION 3. The changes in law made by this Act apply to a |
|
|
guardianship created before, on, or after the effective date of |
|
|
this Act. |
|
|
SECTION 4. This Act takes effect September 1, 2011. |
