A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to certain investigations conducted by the Texas Alcoholic |
|
|
Beverage Commission. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 5.36, Alcoholic Beverage Code, is |
|
|
amended by adding Subsection (b) to read as follows: |
|
|
(b) When conducting an investigation relating to an |
|
|
accident that resulted from an individual operating a motor vehicle |
|
|
while under the influence of alcohol, the commission shall |
|
|
investigate each licensed or permitted establishment where the |
|
|
individual obtained alcoholic beverages during the 24 hours |
|
|
preceding the accident to determine whether the establishment |
|
|
violated this code in connection with selling or serving an |
|
|
alcoholic beverage to the individual. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
