A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the use of contracts by local governments to purchase |
|
|
electricity. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subdivision (8), Section 271.003, Local |
|
|
Government Code, is amended to read as follows: |
|
|
(8) "Personal property" includes appliances, |
|
|
equipment, facilities, and furnishings, or an interest in personal |
|
|
property, whether movable or fixed, considered by the governing |
|
|
body of the governmental agency to be necessary, useful, or |
|
|
appropriate to one or more purposes of the governmental agency. The |
|
|
term includes all materials and labor incident to the installation |
|
|
of that personal property. The term includes electricity. The term |
|
|
does not include real property. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
