A BILL TO BE ENTITLED
 
AN ACT
  relating to inspections and license renewals by the Texas
  Department of Licensing and Regulation.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 51.351, Occupations Code, is amended by
  adding Subsection (e) to read as follows:
         (e)  Notwithstanding any other law, the commission by rule
  may prescribe the time between periodic inspections conducted by
  the department. In adopting rules under this subsection, the
  commission shall consider:
               (1)  the risks to public health and safety posed by the
  regulated activity that is subject to inspection; and
               (2)  the available resources of the department.
         SECTION 2.  Sections 51.401(c) and (d), Occupations Code,
  are amended to read as follows:
         (c)  A person whose license has been expired for more than 90
  days but less than three years [one year] may renew the license by
  paying to the department a renewal fee that is equal to two times
  the normally required renewal fee.
         (d)  A person whose license has been expired for three years
  [one year] or more may not renew the license. The person may obtain
  a new license by complying with the requirements and procedures,
  including the examination requirements, for obtaining an original
  license.
         SECTION 3.  The changes in law made by this Act apply only to
  an application for the renewal of a license that is filed with the
  Texas Department of Licensing and Regulation on or after the
  effective date of this Act. An application for the renewal of a
  license that is filed before the effective date of this Act is
  governed by the law in effect on the date the application was filed,
  and the former law is continued in effect for that purpose.
         SECTION 4.  This Act takes effect September 1, 2011.
