A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to inspections and license renewals by the Texas |
|
Department of Licensing and Regulation. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 51.351, Occupations Code, is amended by |
|
adding Subsection (e) to read as follows: |
|
(e) Notwithstanding any other law, the commission by rule |
|
may prescribe the time between periodic inspections conducted by |
|
the department. In adopting rules under this subsection, the |
|
commission shall consider: |
|
(1) the risks to public health and safety posed by the |
|
regulated activity that is subject to inspection; and |
|
(2) the available resources of the department. |
|
SECTION 2. Sections 51.401(c) and (d), Occupations Code, |
|
are amended to read as follows: |
|
(c) A person whose license has been expired for more than 90 |
|
days but less than three years [one year] may renew the license by |
|
paying to the department a renewal fee that is equal to two times |
|
the normally required renewal fee. |
|
(d) A person whose license has been expired for three years |
|
[one year] or more may not renew the license. The person may obtain |
|
a new license by complying with the requirements and procedures, |
|
including the examination requirements, for obtaining an original |
|
license. |
|
SECTION 3. The changes in law made by this Act apply only to |
|
an application for the renewal of a license that is filed with the |
|
Texas Department of Licensing and Regulation on or after the |
|
effective date of this Act. An application for the renewal of a |
|
license that is filed before the effective date of this Act is |
|
governed by the law in effect on the date the application was filed, |
|
and the former law is continued in effect for that purpose. |
|
SECTION 4. This Act takes effect September 1, 2011. |
