A BILL TO BE ENTITLED

AN ACT

|
relating to the use of a mobile tracking device without a court |
|
|
order in the course of a criminal investigation. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 14, Article 18.21, Code of Criminal |
|
|
Procedure, is amended by adding Subsection (h) to read as follows: |
|
|
(h) This section does not prohibit the installation and use |
|
|
of a mobile tracking device without an order in the course of a |
|
|
criminal investigation if an order is not required under the Texas |
|
|
Constitution or United States Constitution. |
|
|
SECTION 2. This Act takes effect September 1, 2011. |
