A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the occupational licensing of spouses of members of the |
|
military. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. The heading to Chapter 55, Occupations Code, is |
|
amended to read as follows: |
|
CHAPTER 55. [RENEWAL OF] LICENSE WHILE ON MILITARY DUTY |
|
SECTION 2. Chapter 55, Occupations Code, is amended by |
|
adding Section 55.004 to read as follows: |
|
Sec. 55.004. ALTERNATIVE LICENSE PROCEDURE FOR MILITARY |
|
SPOUSE. (a) A state agency that issues a license shall adopt rules |
|
for the issuance of a license to an applicant who is the spouse of a |
|
person serving on active duty as a member of the armed forces of the |
|
United States. |
|
(b) Rules adopted under this section must include |
|
provisions to allow: |
|
(1) alternative demonstrations of competency to meet |
|
the requirements for obtaining the license; and |
|
(2) a period during which an otherwise qualified |
|
person may seek employment or practice with an expired license. |
|
(c) The executive director of the Texas Department of |
|
Licensing and Regulation may issue a license by endorsement in the |
|
same manner as the Texas Commission of Licensing and Regulation |
|
under Section 51.404 to an applicant described by Subsection (a). |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
